Legal Information & Terms and Conditions of Use

Please review the following terms and conditions concerning submission of design material to Bentley Gallery. By submitting a design file, clicking the "Submit" button and completing the online registration form, you enter into an agreement with Bentley Systems, Incorporated, indicate that you agree to be bound by these terms and conditions and acknowledge that you have read and understand this agreement with the express understanding that it limits your claim to the rights described herein.

RELEASE AGREEMENT

Your submission of a completed Submittal Form indicates that you grant to Bentley Systems, incorporated, its subsidiaries, affiliates, sub-licensees and assigns (collectively referred to as “Bentley”) a perpetual, worldwide, nonexclusive, royalty-free right to use, reproduce, display, distribute or incorporate in any way, in any medium, now known or to be developed, the submitted design materials (the “Materials”), or any portion thereof, as well as the right to prepare derivative works based upon the Materials for marketing, presales support, advertising and training. Bentley shall have no obligation to return the Materials.

By submitting the Materials, you hereby represent and warrant that (i) you are the exclusive owner of all rights in the Material and that the Material is not the subject of third party liens or claims of ownership, (ii) the Material does not infringe any copyright, trademark or other third party proprietary rights and complies with all applicable laws, and (iii) no further permissions, or compensations are required for use of the Material. You agree to indemnify and hold harmless Bentley, its subsidiaries, affiliates, assigns, agents and employees, against liability should any third-party claim that the use of the materials by Bentley violates any right of such third party to the Materials. You further waive any right to review or approve any works in which the Materials may appear, and waive any and all claims against Bentley related to Bentley’s ordinary use of the Materials.

Acceptable Use Policy

When submitting information to Bentley Gallery, you agree not to:

Upload, post or otherwise transmit any data or content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable or harmful to minors in any way.
Impersonate any person or entity, including, but not limited to, a Bentley official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Upload, post or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
Upload, post or otherwise transmit any content that infringes or unlawfully discloses any patent, trademark, trade secret, copyright or other proprietary rights of any party.
Upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
Upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
Interfere with or disrupt Bentley or servers or networks connected to Bentley, or disobey any requirements, procedures, policies or regulations of networks connected to Bentley.
"Stalk" or otherwise harass another.
Collect or store personal data about other users.
Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs, grenades and other weapons, and creating "crush" sites.
Use your project hosting site (or directory) as storage for remote loading or as a door or signpost to another home page, whether inside or beyond Bentley.
You also agree to not use Bentley to engage in commercial activities without enrolling in Bentley approved affiliate programs. This includes, but is not limited to, the following activities:
Offering for sale any products or services.
Soliciting for advertisers or sponsors.
Conducting raffles or contests that require any type of entry fee.
Displaying a sponsorship banner of any kind.
Displaying banners for services that provide cash or cash-equivalent prizes to users in exchange for hyperlinks to their web sites.
Malicious intent. You agree not to tamper in any way with the software or functionality of the site. Without limiting the foregoing, you agree not to put any material into the site which contains any viruses, time bombs, trojan horses, worms, cancelbots or other computer programming routines that may damage, interfere with, intercept or expropriate any system, data or information. You further agree to not utilize bots, agents, auction crawlers and other computer based crawling programs on the site.

PRIVACY POLICY NOTICE

Bentley’s personalization, interactive communications, online commerce and other types of online services, most of which are completely free to you, allow us to deliver better service and content that is relevant to our Subscriber base. We understand that you have confidential business information and are committed to safeguarding your privacy online and maintaining the private nature of individually identifiable information provided to or collected by Bentley. To that end, Bentley strives to make our site as safe and secure as reasonably possible by following four basic worldwide principles to ensure your privacy and data protection online: Notice, Consent, Access, and Security. Bentley strictly protects the security of your personal information and honors your choices for its intended use. We carefully protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction. Anytime a password or personal information is provided by a user to Bentley Gallery, it is encrypted using Secure Socket Layer (SSL) technology. SSL provides strong encryption to all digital information as it crosses the Internet. Additionally, some areas of the site will be inaccessible without a password, even though you may have already logged onto our site. This is to ensure that cookies cannot be used to bypass security measures that you would otherwise take to protect your data and Personal Information. The physical hardware and software components of the Bentley Gallery Web site are protected against attack and natural disasters. The systems contain all of the resources required to support large-scale applications. The data center is under surveillance on a 24/7 basis to ensure maximum security. All software applications which share user information also offers security and user access options at the site, group, folder and file levels, under security permissions rules specified by the site administrator, tracking all usage and modifications of files by users granted access. We use advanced security technology to ensure that your personal data remains private within our site. While no data transmission over the Internet can be guaranteed to be 100% secure, Bentley strives to protect your personal information. We cannot, however, ensure or warrant the security of any information you transmit to us or from our online products or services.
